The Smoking Gun has given out their Legal Document of the Year award for 2003. Knowing the creative lunacy of the american legal profession, this might be premature, but I’d have to stand behind them on this one.
TSG has a 7 page brief detailing the history of the “F” word filed by Deputy Colorado Public Defender Eric Vanatta on behalf of his juvenile defendant who was accused of disorderly conduct and “interfering with the staff, faculty, or students of an educational institution” for cursing at his principal. I wish Eric could have gone to trial so that every kid who curses out his principal (which I believe is inevitable) could cite this case, but the defendant took a plea. Sigh.
